Does that include code for product like organic charcoal?
I don't believe the HTS code for charcoal was included in this update, but if it was, then you would need to start using the new code as of August 1, 2024.
In the USA commercial invoices created by whom then?

every product if not ITAR has an ECCN, EAR99 is an ECCN
